Terms of Service

The agreement between you and us. Written to be read once and understood, rather than skimmed and regretted.

Who we are, and what these terms cover

“We” is Jayasri Das (Sole Proprietorship), trading as VyomAnanta, at SILIGURI - 733207, West Bengal, India. “You” is the person or business buying from us. These terms apply whenever you buy or use anything we sell.

How the service is delivered

The cloud services we sell — virtual servers, GPU instances, dedicated machines, shared hosting, storage, business email and domain registration — run in professional datacentres operated by our infrastructure partners. VyomAnanta does not own the buildings or the hardware. What the VyomAnanta team does own is everything around it: choosing the machines worth selling, pricing them, provisioning them, configuring them, and answering you when something is wrong.

We are your single point of contact. You never chase a datacentre, open a ticket in a foreign timezone, or get told a problem belongs to someone else. You message us, a person reads it, and we deal with whoever needs dealing with.

One thing follows from this that we would rather say here than have you discover on a bad afternoon: if the underlying datacentre has an outage, we have an outage, and we cannot repair hardware we do not own any faster than the people who do. What we can do — and will — is tell you what is actually happening, keep telling you, and push it until it is fixed.

Our AI automation work is different. That is designed, built and run by the VyomAnanta team.

What you can hold us to

  • A real registered business. A proprietorship with a Udyam registration, a named proprietor and an address, all printed at the foot of this page. You are not buying from an anonymous checkout.
  • A person answers. Email or WhatsApp reaches a human being, usually within the hour during working hours. There is no ticket queue and no bot standing in front of us.
  • The price you see is the price you pay. No setup fees, no GST added, no first-year discount that doubles at renewal. Domains renew at exactly what they cost to register, and that is printed on every card rather than in a footnote.
  • Every specification on this site is read from a live catalogue, not typed in by hand. When something changes, the page changes. Where a figure is missing or unconfirmed, we say so on the page instead of filling the gap with a plausible guess.
  • We tell you what we cannot do. There is no SLA here, backups are your responsibility unless bought, and both of those are stated plainly above rather than buried. A vendor who admits limits before you buy is telling you the truth about the rest.
  • Cancel whenever you like. No minimum term, no cancellation fee, no phone call required to leave.

Accounts

  • You need an account to buy from us, and the details on it must be accurate. Invoices are raised against what you tell us.
  • You are responsible for what happens under your account, including keeping the password safe. Tell us immediately if you think someone else has access.
  • You must be 18 or over, and able to enter a contract.

Prices, payment and tax

No GST is charged

We are not registered for GST, so no GST is added to anything on this site. The price shown is the price you pay. We cannot issue a GST invoice and you cannot claim input credit on what you buy from us. If your business needs a GST invoice, tell us before you order — it is better for both of us to know now.

If we do register for GST in future, prices will change to reflect it and we will tell you before it applies to you.

Paying

  • Services are billed in advance. We provision after payment clears, not before.
  • Payments are handled by PayU. We never see your card. Wallet balance, where you have one, is credit toward our services and is not withdrawable — see the refund policy.
  • Monthly services renew monthly until you cancel. Domains are billed yearly.
  • If a renewal payment fails, we will tell you and give you a reasonable chance to fix it before anything is suspended. We are not interested in catching you out; we are interested in not paying the datacentre for a machine nobody is paying us for.

What we promise, and what we do not

We will provision what you paid for, keep it running as well as the underlying platform allows, and answer you when you ask for help.

We do not offer a contractual uptime guarantee or service credits. Any availability figure quoted anywhere on this site describes what the underlying platform publishes, not a promise from us. Promising 99.9% on infrastructure we do not own would be a promise we cannot keep, and we would rather have no SLA than a dishonest one. If you need a contractual SLA, tell us and we will say whether that is something we can arrange.

Backups are your responsibility unless you have bought a backup service in writing. Some plans include platform-side backups; where they do, it is stated on the plan. Do not assume.

What you must not do with it

Do not use anything you buy from us to:

  • break Indian law, or the law where your service runs;
  • send spam, run phishing, distribute malware, or attack other systems;
  • host child sexual abuse material — this results in immediate termination and a report to the authorities, with no refund and no notice;
  • infringe someone else’s copyright or trade marks;
  • mine cryptocurrency on shared hosting or on plans not sold for it;
  • deliberately consume resources in a way that degrades the service for other customers.

If we have to suspend a service for something on this list, we will tell you why and, where the situation allows it, give you a chance to fix it first. For the serious items above, we will not.

Automation work

AI automation is sold as a project or a retainer, with the scope agreed in writing before work starts. Milestones and what each one includes are set out in that agreement. Where we build something for you and you have paid for it, you own the output; the underlying tools, libraries and methods remain ours to reuse.

We intend to offer some automation services directly through this website in future. Until that exists, automation is arranged with a person.

Ending it

  • You can cancel any monthly service at any time. It runs to the end of the period you have paid for, then stops. See the refund policy for what comes back.
  • We may suspend or terminate for non-payment, or for the prohibited uses above.
  • If we ever decide to stop offering a service you rely on, we will give you at least 30 days’ notice and help you move.
  • Data is deleted when a service is terminated. Take your backups before cancelling. Once a machine is destroyed in the datacentre, we cannot get it back — that is not a policy, it is a physical fact.

Liability

If we cause you loss, our total liability is limited to what you paid us for the affected service in the three months before the problem. We are not liable for lost profits, lost data, or losses that follow on from an outage.

That is a real limit and you should read it as one: we are a small business selling low-cost infrastructure, and we cannot underwrite the consequences of a business failure. If what you are running on us is worth more than that, insure it and back it up elsewhere. Nothing here limits liability that cannot be limited by law.

Disputes

Talk to us first — nilanjan@vyomananta.com. Most things are a misunderstanding and are fixed in a day. Failing that, these terms are governed by Indian law and the courts at the courts at Islampur, Uttar Dinajpur, West Bengal have jurisdiction.

Changes

We may update these terms. If a change materially affects you, we will email you before it takes effect, and continuing to use the service after that means you accept it. If you do not, cancel — the refund policy applies as normal.
